Court upholds long-standing RESPA interpretation in PHH v. CFPBThe Court of Appeals for the District of Columbia has released the long-awaited decision for PHH Corp. v. Consumer Financial Protection Bureau, and it is an exciting victory for industry participants. The case rules that the bureau’s single-director structure is unconstitutional, that the bureau’s retroactive application of a new RESPA Section 8 interpretation violated PHH’s due process, among other things.
