Q: If a product is dangerous, causes harm, and it's being used in a perfectly normal way, why would you need an expert witness in a lawsuit? Isn't that strict liability?
A: Your opponent is going to submit testimony and evidence to try to establish that the product has no design or manufacturing defect. The Kentucky Supreme Court has ruled that a medical malpractice lawsuit can move forward, siding with an appeals court's decision that a trial court judge erred when he dismissed the case for lack of an expert witness.
